I thought this piece in The Age summed up everything that is f%$#@d about this case.

 

I had a good brows around http://oscarpistorius.com and it's sickening how his PR people have turned it into a shrine of support for Pistorius. Makes you sick to read it.

 

 

Everyone's a victim. Including even the guy who puts a few rounds into his girlfriend apparently.

 

But seriously how bad are the SA police. Yeah lets put the guy with an attempted murder thing hanging over him on the case...

I might have misheard, but I'm sure on the radio they said that SA does not have a jury system. How does that work then? They also said that the press pretty much have free reign as there is no jury to influence with what they write, but surely someone has to make a decision somewhere, and wouldn't they be just as susceptible to journalistic influence?

Hi, First post,so go easy but just pointing out a couple of things

 

Is it legal to blow holes in imaginary burglars hiding behind closed doors over there? Can't see how it's self defence if he hasn't identified who was in the closed room, they haven't made any threats either verbal or physical towards him and he isn't in any danger.

 

And is it just me or is it fishy that the "cop" is up on murder charges for shooting into a minibus which went away and have been reinstated in the last few days according to the TV reports.

 

And is every second (white) person over there named Botha?

 

 

Just like here it isn't ok to shoot through doors , but bail was given because there was no absolute evidence given of premeditation....the cop situation is stupid, but he will probably be ok,and no Botha is less than vd Merwe,which is less than Smith...same here but Ng or Ngyuyen probably more here so is every second person Ng?

 

What a joke! The judge said amongst other things in his bail review summing up..."Oscar doesn't have a propensity to be violent"...& "is not a flight risk". What is the world coming to?!?! I feel sorry for the victim's family.

 

Actually a magistrate, the real trial will be in supreme court, but the prosecution didn't do a good job and stuffed by defence so what do you really expect vthe judge to do, his job is not to make the prosecution's job. The bail was about premeditation vs possibilty that his story is plausible, that is all so if they couldn't prove premeditation then it is a different story with violent propensity as you say.

 

As far as I can read in press and forums most of the people are on the side of the prosecuition so I don't think he is hero worshipped. Thisngs are quite different in SA to what I read here.

I read no danger to flee and no risk to society. Whether I agree or not, that would be the law in most western countries, right?

 

Earlier comments suggest he will not face jail time. Interesting in that a protracted trial with appeals the sentence is usually for time served plus the balance. In this case their is no "time served" so i could see short sentence 12-24 months for involuntary manslaughter in a plea bargain.

So the neighbour has testified so far. She says she was awoken by bloodcurdling screams coming from his house, followed by yells for help, then about 4 shots.

 

There's also been reports that in the past, he's fired a gun through the sunroof of her car, scaring the shit out of her, and also fired his gun in a restaurant.

The female neighbours evidence is revealing & important. Screams & yells for help by a female in Pistorius house.....then shots fired. Looks like prosecution will also introduce evidence into trial that Oscar was watching porn that night just prior to the murder. Also Cops have gained access to his iphone via Apple in the States. Will be interesting to see the texts, internet browsing & texts on 'WhatsApp' that Oscar sent & searched just prior to the murder. I hope he gets found guilty & gets life!!

As for the jury system, this was abolished in South Africa in the late 1960s to ensure that "crimes" were dealt with efficiently. Ironic now that a white man, who killed (as to intent, that is still for deliberation) his girlfriend is being judged by a black, female, ex-journalist who in her day was a rampant feminist. The majority government haven't reintroduced it yet as they see no need....

 

I think the Police's bungling of the investigation is the least of their concerns! I think he's screwed.

So his mate from the restaurant has testified. Seems they were in the restaurant, looking at a gun or something when OP accidentally fired it. The mate actually got some shrapnel in his leg. Certainly trying to paint a picture of him as being a bit of a gun nut. The mate also said the OP asked him to take the rap for firing the gun! If that's the case he doesn't seem to like taking responsibility for his actions.

That's usually the way in corrupt countries when you have money (and is his case fame).

 

I still think he will get away with it on some sort of technicality but certainly hope not.

The judge has allowed the trial to be fully televised to help remove any suggestion that his money or power might influence the verdict. I think with the world watching there is a very strong incentive for the South African legal system to demonstrate fairness and impartiality. If anything I think bias might work against him.

I don't think it's being fully televised is it? Three fixed cameras and witnesses can opt out if they want and as far as I know OP's testimony won't be televised at all will it? ( I thought these were the conditions but could be wrong).

You can watch on SKY news live. Witness' can opt out of the visual but you still hear their testimony.

Found not guilty of murder. Can still be found guilty of manslaughter. Probably won't.

I doubt if he gets any jail time. I heard today that the Parole Officer said no jail has the facilities where he can even have a shower given his disabilities, so the authorities were recommending house detention.

Less than what most people think he deserves, more than what they thought he would get. I see one of the sporting bodies have banned him for the term of the full 5 year sentence though so his sporting career is over.

Will his lawyers take a shot in the dark at an appeal ?

I think there is a real risk the sentence might be increased before a full bench on appeal. He might do well to take his medicine.
